Past the Point of No Return

Finished. I might just have handed in my final exam paper. Now begins the waiting game, but for all intents and purposes, I have left my shackles behind. Freedom!

Of course, that is, unless freedom is a curse like the binding was. If one cannot decide for himself, then where is one to go. Contingency plans, where art thou? Bah. What for do I care? For now, I shall concentrate my efforts on the coming weekend.

Final Exam coming up

This is it. The last exam. The final hurdle. Do this, and I am freed from all conventions of my currently chosen path of learning. Come now, cast of the chains that have bound you to this shallow plain and ascend with me for the final climb, towards the promised place! ONWARDS!

University Life - Almost Done

Week 2 of final exams. I hate these, you have to start way too early in the morning and then it turns into a kind of endurance race for five hours in which you can only hope to have learned and understood enough to solve the particular problems turning up in THAT ONE CASE. Today, tomorrow and Thursday, then it´s in the hands of higher authorities than mine. Heres to me and hoping for victory. Just in case, I might fail, I will have to prepare for some contingency plans.

Law - Humans

About the alignment of humans, ever since the earliest DnD-rules it was written for humans:

"Humans are a race with the most diverse of all aligments. The best and the worst can be found among them."

Indeed, this morning we worked with a few cases of criminal law. Humans can be disgusting bastards.

Ich möchte die Behauptung aufstellen, dass es nicht sein kann, dass es einen Zustand ohne Recht gibt. Schliesslich kennen wir als Naturrecht das Recht des Stärkeren. So ist immer ein Recht gegeben.

Der oberste Grundsatz der Sittenlehre ist also: 

handle nach einer Maxime, die zugleich als allgemeines Gesetz gelten kann. - jede Maxime, die sich hiezu nicht qualificirt, ist der Moral zuwider.

Zu Preuß und Marx

Ist also die Rechsstaatliche Diktatur, da die Verfassungsinstitutionen den Kern gesellschaftlichter Substanz umfassen und auch ohne Handlung von Außen garantieren eine Konstitution negativen Ursprungs?

Oder wäre ein somit gebildeter Autokratischer Republikanismus vielleicht sogar wünschenswerter?

Fälle im Sozialrecht

K hat nur einen Hoden. Das nimmt ihn ganz dolle mit. Deshalb hat er sich einen Kunsthoden einsetzen lassen. Nun verklagt er die gesetzliche Krankenkasse auf die 4000€ die ihn das ganze gekostet hat, weil er meint, einen Anspruch aus dem Körperzustand, nur einen Hoden zu haben, herrührt.

Das BundesSozialGericht lehnt den Anspruch ab.
